What Build Pro is

Build Pro is a business platform for contractors: leads, estimates, contracts, jobs, invoices, deadline tracking, and the records that connect them, in one place. These Terms & Conditions are the agreement between you and Build Pro for using the product. By creating an account, or by accepting these Terms inside the product, you agree to them for yourself and for your company.

If you use Build Pro on behalf of a company, you are telling us you have the authority to accept these Terms for that company.

Your account

Your account is yours to run. Keep your sign-in details to yourself, and keep your company information — your name, address, license details, and the customer records you enter — accurate and current; the product builds documents and deadlines from what you enter.

People on your team sign in under your company. You are responsible for what happens under your company’s accounts, including the settings your team sees and the documents they generate from your adopted settings.

Your settings

Build Pro provides reference information compiled from publicly available sources, displayed with citations to those sources. Settings you adopt in Build Pro — including deadline windows, thresholds, and limits — are your own business settings, chosen and controlled by you. Build Pro does not set, certify, or guarantee them.

Not legal advice

Build Pro is not a law firm, and use of Build Pro does not create an attorney–client relationship. Nothing in the product — including library content, deadline calculations, and generated documents — is legal advice or a substitute for the advice of your own licensed attorney or the responsible agency.

Deadlines and documents

Deadline reminders are calculated from the dates you enter and the settings you adopt. A reminder is an aid to your own tracking, not a determination that a deadline exists, has been met, or has expired. Legal service, filing, and recording are performed by you or your agents; Build Pro never performs them on your behalf.

Documents Build Pro generates are assembled from your records and your adopted settings, and each generated document carries its provenance: the source library and adoption record it was built from. Review every document before you rely on it or send it — it goes out under your name, as your document.

Sources change

Laws, regulations, and published guidance change. Build Pro updates its libraries and will notify you when an update touches a setting you have adopted; your adopted settings do not change unless you change them.

Your responsibility; indemnification

You are responsible for verifying the information in the libraries against the cited sources and for the settings you adopt, the documents you generate, and the deadlines you act on. To the fullest extent permitted by law, you agree to indemnify and hold harmless Build Pro and its operators from claims, damages, and expenses arising from your settings, your documents, and your reliance on library information you adopted. Build Pro compiles its libraries with care from published sources but does not warrant that any item is complete, current, or correct for your facts.

Acceptable use

Use Build Pro for your own business. Do not use it to send unlawful or deceptive communications, to enter records you have no right to use, to interfere with the product’s operation or security, or to copy the product itself for resale as a competing service. Marketing features in the product carry their own stated rules — an address on the suppression list is never mailed, and marketing mail always carries a working way to opt out.

Fees, plans, and payment

Build Pro is offered in plans, including a free starting plan described in the product. Paid plans are billed through Stripe’s hosted payment pages; card details go to Stripe and are never stored by Build Pro. Plan prices are the prices shown in the product when you subscribe.

If a paid plan’s payment fails, Build Pro may suspend the paid features after a grace period the product states, until payment is made. Your records stay yours during a suspension: you can still sign in and export them. Price changes for an existing subscription are announced in the product before they take effect for you.

Your records and our product

Your business records — your customers, estimates, contracts, jobs, invoices, documents, and settings — are yours. Build Pro stores and processes them to run the product for you, and for no other purpose; your data is never sold and never shared with marketing.

The product itself — its software, design, libraries’ compilation, and documentation — belongs to Build Pro and its operators. Your subscription gives you the use of it for your business; it does not transfer ownership of any part of it.

Suspension and ending the service

You may stop using Build Pro at any time, and the company owner may request account deletion from inside the product or through the deletion page; the deletion page explains exactly what happens then.

Build Pro may suspend or end an account that is used in a way these Terms do not allow, that has unpaid fees past the stated grace period, or that puts the product or other customers at risk. If Build Pro ever ends the service itself, we will say so in the product with reasonable notice, and your records remain exportable for a stated period afterward.

Warranty and liability

Build Pro is provided as described in the product. Beyond what these Terms state, Build Pro and its operators make no warranty that the product will be uninterrupted, error-free, or right for your particular facts — including the library items described above, which are compiled from published sources with care but not warranted complete, current, or correct for your situation.

To the fullest extent permitted by law, Build Pro and its operators are not liable for indirect or consequential losses arising from your use of the product, and their total liability arising from the product is limited to the fees you paid for the product in the twelve months before the claim arose (or, on a free plan, one hundred dollars).

Changes to these Terms

These Terms carry a version number and an effective date. When the Terms change, the new version is published at the Terms page in the product, with notice in the product before it takes effect. Accepting the new version inside the product records your acceptance of that version; versions you accepted earlier stay on record as accepted, exactly as they were.

If a change is ever one you cannot accept, you may stop using the product and request deletion as described above.

How these Terms work

These Terms are the whole agreement between you and Build Pro about the product. If any part of them is found unenforceable, the rest stands. Not enforcing a part of these Terms once is not a waiver of it. You may not assign your account or these Terms to someone else without our agreement; Build Pro may assign them as part of a transfer of the service, with notice in the product.

These Terms are governed by the laws of the State of California. Questions about these Terms: email grace@hungrymuse.com.
